US Appeals Court Rules Tesla Can Challenge Louisiana’s Direct Sales Ban

Tesla has secured a notable victory in its ongoing legal battle against Louisiana’s direct sales ban. A recent ruling by the 5th U.S. Circuit Court of Appeals in New Orleans has opened the door for Tesla to challenge the state’s restrictive sales practices, potentially reshaping the automotive retail landscape in Louisiana.

The appeals court’s 2-1 decision marks a turning point in Tesla’s legal strategy. The ruling reversed the dismissal of Tesla’s due process claim and vacated the dismissal of its antitrust claim, while upholding the dismissal of its equal protection claim. This mixed result provides Tesla with renewed legal avenues to pursue its case against the Louisiana Automobile Dealers Association and the Louisiana Motor Vehicle Commission.

Tesla’s lawsuit, filed in August 2022, targets what the company perceives as unfair practices that have effectively barred it from selling directly to consumers in Louisiana since 2017. The electric automaker has accused state officials and dealership associations of exploiting their control over the motor vehicle commission to drive Tesla out of the market by targeting its unique sales model.

Circuit Judge Jerry Smith, in his opinion, noted that Tesla had sufficiently alleged “plausible actual bias” among the defendants. This assertion was supported by evidence including emails from the commission’s executive director, which appeared to show preferential treatment towards Tesla’s competitors.

The ruling was not unanimous, with Judge Dana Douglas dissenting. Her opinion cautioned against using the court to circumvent the legislative process, highlighting the complex interplay between corporate interests and state regulations.

As this legal battle continues to unfold, it’s clear that Tesla is charging ahead in its efforts to reshape automotive sales practices.
